The European Banking Authority (EBA) is an independent EU authority established in 2011 under Regulation (EC) No. 1093/2010 and later amended by Regulation (EU) No 1022/2013. Main Responsibilities
The Legal Expert position is part of the EBA's Legal Unit and involves the following key duties:
- Providing expert legal support to the EBA's governing bodies, panels, management, and core functions.
- Ensuring a sound legal environment for the EBA's operations, identifying and preventing legal risks.
- Offering legal analysis and advice on regulatory, oversight, consumer protection, and financial innovation functions.
- Drafting and interpreting internal implementing rules, procedures, and decisions.
- Managing legal aspects of litigation and representing the EBA before the Board of Appeal and the Court of Justice.
- Coordinating legal advice for standing committees and other groups, and ensuring cooperation with other ESAs, EU institutions, and competent authorities.
- Monitoring legal developments relevant to the EBA's tasks and liaising with external stakeholders.
- Executing other related tasks as required by the Head of the Legal Unit.
Requirements
1. Eligibility Criteria
- Language: Thorough knowledge of one EU language and satisfactory knowledge of another.
- Nationality: Must be a national of an EU Member State, an EFTA Member State, or a country with which the Council has opened accession negotiations.
- Citizenship Rights: Must be entitled to full rights as a citizen.
2. Qualifications
- Must have a university degree of at least three years, recognized by EU or EEA authorities or equivalent.
- If the degree was obtained outside the EU, it must be recognized by an EU Member State authority.
3. Professional Experience
- Minimum of 12 years of full-time professional experience after completing education.
- At least 6 years of experience in a legal function.
4. Language Skills
- Excellent knowledge of English (both written and spoken).
- Native English speakers must demonstrate proficiency in a second language.
Selection Criteria
Candidates must demonstrate:
- Proven experience in providing legal advice relevant to the EBA's tasks.
- Strong knowledge of EU law and institutional framework.
- Experience in drafting legal documents in English.
They must also possess the following competencies:
- Ability to investigate and analyze complex legal information and propose effective solutions.
- Capacity to present legal developments to policy and operational colleagues.
- Strong sense of responsibility, commitment, and cooperation.

Appointment and Engagement Conditions
- The position is a secondment from a national supervisory authority or an IGO.
- Duration: Minimum 12 months, up to 24 months, renewable.
- The home authority remains the employer and must continue to pay salary and maintain social rights.
- Estimated starting date: 1 September 2016.
Conditions of Secondment
- The EBA provides daily and monthly subsistence allowances, adjusted annually by the Commission and based on exchange rates and a country correction coefficient for the UK.

Appeal Procedure
9.1 Request for Review
- Candidates may request a review of the Selection Committee's decision within 10 days of receiving the decision.
9.2 Appeals
- To the EU Civil Service Tribunal: Under Article 270 of the Treaty on the Functioning of the European Union and Article 91 of the Staff Regulations.
- To the European Ombudsman: Pursuant to Article 228(1) of the Treaty on the Functioning of the European Union, with the condition that administrative approaches have been made first.
9.3 Complaint to the European Ombudsman
- The Ombudsman's office is located at 1 Avenue du Président Robert Schuman, Strasbourg Cedex, France.
- Complaints to the Ombudsman do not suspend the time limits for appeals to the Civil Service Tribunal.
