Core Content
The European Banking Authority (EBA) Board of Supervisors (BoS) meeting held on 16-17 October 2013 covered a range of topics, including the approval of agendas, risk assessment, regulatory frameworks, and the development of supervisory guidelines and procedures. The meeting also addressed the EBA's role in the European System of Financial Supervision (ESFS) and the preparation of reports and technical standards.
Main Points and Decisions
Agenda Item 2: Opening, Welcome & Approval of the Agenda and Minutes
- New BoS members and representatives were appointed: Mr Yiangos Demetriou (Cyprus), Mr Cyril Roux (Ireland), Mr Alexander Demarco (Malta), Mr Marton Nagy (Hungary), and Mr Peter Gabriel (Alternate for Hungary).
- The draft BoS agenda and minutes from the 1-2 July 2013 meeting were approved.
- Agenda items were split into Session A (priority items) and Session B (items discussed based on remaining time).
- A short written procedure was agreed to seek approval for the publication of the Risk Dashboard.
Agenda Item 3: Risk and Vulnerabilities
- The Risk Dashboard Q3 2013 was presented, and the EBA intended to publish it quarterly starting from this quarter.
- The SCOP Chairperson provided an update on European-wide measures and actions taken in response to the letter.
- BoS members broadly agreed on the risks noted and expressed concerns about non-EU risks.
- The BoS endorsed the Risk Dashboard with an exit criterion of below 90 days past-due and an implementation date of September 2014, with a remittance date postponed to December 2014.
- The EBA staff was requested to amend the ITS to include the legal source as suggested by the Commission representative.
Agenda Item 4: Selection of Standing Committee Chairpersons
- The selection of SC Chairpersons was discussed, with a two-year mandate starting in April 2011.
- A call for applications was launched on 25 September 2013, but only one application was received per SC, except for the Peer Review Panel.
- The Commission representative supported the common definitions and suggested harmonisation with the Single Supervisory Mechanism (SSM) Balance Sheet Assessment.
- The BoS agreed to a quick procedure to renew the mandate of the SCs.
Agenda Item 5: Disclosure Exercise
- A transparency exercise was agreed to be undertaken in late 2013, with three options for disclosure.
- The BoS agreed to focus on two intermediate proposals, discarding the most and least demanding ones.
- The BoS approved the disclosure exercise according to Option 2 (medium), with extra data collection under Option 3a.
- The reference dates were set as December 2012 and June 2013, and country coverage was defined to include 90% of total EAD and top 10 countries in terms of exposure.
- A written procedure would be launched to collect feedback and comments from BoS members.
Agenda Item 6: Definition of Forbearance and Non-Performing Exposures
- The BoS supported the asymmetric treatment of forbearance and non-performing exposures.
- The exit criterion from non-performing classification was set at below 90 days past-due.
- The implementation date was set for September 2014, with the remittance date postponed to December 2014.
- The Commission representative encouraged the EBA to seek all related TS in one batch and strengthen the legal basis of the ITS.
Agenda Item 7: Draft Decision on Reporting Phase 2
- The draft decision on Reporting Phase 2 was approved by simple majority.
- The reporting sample was to be finalized based on 2013 data in early 2014.
- The BoS supported the idea of expanding the sample if approved by the BoS.
Agenda Item 8: Common SREP and GL Procedures
- The SCOP Chairperson outlined the key objectives and elements of the common SREP framework.
- The BoS requested further clarification on the interaction between elements, level of detail in the Guidelines, and the forward-looking time horizon.
- The BoS supported the proportional application of the SREP process based on institution type.
- A written procedure was agreed to collect feedback on the BMA module of the Single Supervisory Handbook (SSH).
Agenda Item 9: Business Model Analysis (BMA)
- The BMA module was presented for the first time.
- The BoS raised several comments on the module, including reducing the length of the introductory sections, clarifying the role of BMA, and improving proportionality.
- A written procedure would be launched to collect feedback, and a field test was suggested.
- The BoS agreed to start working on the assessment of recovery plans as the next pilot module.
Agenda Item 10: EBA's Contribution to ESFS Review
- The draft letter to the Commissioner Barnier was discussed, covering the EBA's role in regulation, mediation, stress testing, and budget.
- The BoS supported the draft letter but opposed the idea of binding mediation.
- The Commission representative supported mediation as a coordination tool.
- The BoS agreed to resubmit the draft letter for comments via written procedure and to amend it based on feedback.
Agenda Item 11: Liquidity Measures
- The final report on liquidity measures under Article 509(1) and the uniform definitions of liquid assets under Article 509(3) were discussed.
- The BoS agreed that the public version of the report should not include country-specific references.
- The final reports were to be sent to the BoS for approval at the December meeting.
- A conference call was planned in November to prepare for the final reports.
Agenda Item 12: Basel III and Basel II Monitoring
- The ISG report on Basel III QIS and Basel II capital requirements was presented.
- The BCBS resisted the idea of a unique template for reporting.
- The BoS agreed that from the next report onwards, only the Public Basel III report would be produced, with a non-public Annex detailing national developments.
- A technical discussion on the parallel run application of QIS reports was planned for the next BoS meeting.
Agenda Items 13-15: Other Regulatory Topics
- Model Validation: The BoS requested the EBA to simplify the final draft RTS and reassess the materiality threshold.
- Asset Encumbrance: The BoS agreed to resubmit the final draft ITS for a vote via written procedure.
- Remuneration, Leverage Ratio, Benchmarking, and Peer Review: These agenda items were not discussed due to time constraints and were to be addressed via written procedure or conference call.
Agenda Item 21: Reports from Committees
- The SCOP requested written comments on the technical standards submitted to the Commission in July 2013.
- The Away Day meeting was scheduled for 10-11 July 2014 in Krakow, Poland.
